Request for Evidence Attorney

A ‘Request for Evidence’ is the USCIS’s way of saying they need more information before they can make a decision. It could mean your application is missing some information or something in the application and supporting documents has triggered the need for more.

The good news is that you have proof your matter is being reviewed, The bad news is that you probably have one chance to get it right. A last chance to give the USCIS officer all the information they need to competently come to a decision.

This does not mean that it is an opportunity to bury the officer under a blizzard of paperwork ‘just to make sure’ they have enough. It is time to clearly, concisely, within the time allotted, address the request. It does not necessarily mean that all requested information from USCIS is needed or required. We will help to determine what information to give and what information not to give.

This may mean, by the way, explaining why and how you have already answered the question. That, obviously, requires tact.

Don’t try to address this yourself. Turn to a law firm with deep knowledge, years of experience, and a history of successes dealing with Requests for Evidence. Contact Patricia Castillo Flanagan and Work Visa Lawyers, P.A. as quickly as possible – the clock is running the moment you open the envelope.

Some Request for Evidence Facts

First, foremost, a late reply to a request for evidence is the same as ignoring the request. Second, as you have probably already ascertained, the request is in reality a demand. It is also almost certainly your only opportunity to address the issue and supply the requested information. Information that is critical to moving your case to a decision.

Accuracy is vital. If the request is for information that has already been provided or seems unrelated, invasive, or arbitrary, that can be pointed out in the reply – in the right way. A concise, logical, factual reply is needed. It is not the time to try to overwhelm the government with information, or to address other issues, or, certainly, to take it personally. Regardless of how you feel about the necessity of the request for evidence, you must not respond in a personal matter.
